Kinesthetic and Reflective: Applying the Principles of Adult Learning in Judicial Training
Abstract:
Continuing professional development for lawyers differs significantly from the traditional didactic methods of teaching law to university students. It is suggested that the challenges of continuing professional development are particularly pronounced when it comes to training judges.
I was fortunate enough to be invited to take part in a seminar jointly organised by CUHK and the National Judicial Academy of Nepal for the Judiciary of Nepal. Although I serve as a director of the Hong Kong Judicial Institute, I was participating in my private capacity as a PhD candidate, and unable to draw upon to the resources of the HKJI for the purposes of the seminar.
As a result, I would have to develop from scratch the materials I would be presenting to the judges of Nepal across three seminars – not only to meet their stated needs, but also to ensure that my approach would be effective and the knowledge would have a good chance of being retained after the seminar.
For the purposes of the Online Conference on Teaching and Learning in Law, I propose to discuss my experience in designing and presenting training for the judges of Nepal, and experiences subsequently, with a focus on the effectiveness of a problem-solving, kinaesthetic approach in triggering learning and reflection in the context of continuing professional development.
