Abstract:
The key to the excellence of the law students is solid practical ability, which has reached consensus. The law students in the article are studying in universities and have no professional qualifications. The three methods of legal clinic, simulation courses and off-campus internships are considered to be the most important ways to cultivate practical ability at home and abroad. In fact，students are passive participants under the organization of the school in the above three teaching methods. In order to stimulate students’ initiative, the“Pedagogy of Initiative-litigation Cases”may be a more effective method. Its specific content is that students can turn civil disputes into civil actions or civil arbitrations, and also file administrative reporting or administrative actions in accordance with the citizen’s supervision right granted by Constitution of the People’s Republic of China. Therefore, its theoretical basis is the legalization of social issues, and its idea is to encourage students to create a case and handle it under the guidance of a teacher so to achieve“learning by doing”. However, the student is very hard to become the agent of his classmates or other students, and restricted to the agent of close relatives in accordance with the existing law, which reduces many real case sources. In a word, the“Pedagogy of Initiative-litigation Cases”overcomes the shortcomings of insufficient real case sources in the above three methods, and is a supplement to the above three teaching methods, which can improve students’ ability to search for and resolve cases, strengthen professional ethics education, and cultivate students’ sense of social responsibility and ownership.
