Law and Women: An analysis of role of Indian Women in Law

Abstract:

The women form an integral part of the social structure in the society. The worldly affairs are incomplete without the participation of the women. But still being part of the half of the population of the globe the women are meted with hostile discrimination in the society. The women are always considered weaker sex and there are stories of struggle by the women be it developed countries or developing countries for their recognition. The marginalized placement of women in political, economic, social and cultural life brings to the foray the placement of women in society. The discriminatory attitude towards the women especially in India where caste is a predominant factor further adds woes to the status of women in India. The women in India have been abused since time immemorial. Post independence also there is not much advancement of the women. There are instances in history of the struggle of Indian women to be part of the legal system. The women in India have fought for their rights and demanded for an equality status along with men in the society. As far as the legal profession is concerned the women were considered to be far inferior to men to be part of the legal mainstream. The women were not allowed to practice in the courts along with men. In comparison to men the number of women in the legal profession is still very negligible. The reason could be the male chauvinist attitude of the society. India being a male- dominated society very less opportunities is provided to women to be a part of the legal and law- making in the country. Though after the independence of the country the Constitution provides an equality status to the women but lot needs to be done to emancipate women from the archaic and orthodox laws.
